1. Definitions

“Booking” means the order, purchase, rental, hire, payment, booking or reservation of an Offer. 

2. Services and Website Access

2.1 The Ezairticket website offers a booking platform for offers provided by Offer Providers. Users can search, compare, reserve, purchase, or pay for these offers online. Payment can be made through Ezairticket directly from the website or when the traveler arrives at the location of the Offer Provider.

2.2 Prepaid Bookings are those that you pay Ezairticket in advance, with the exception of any fees that you must pay the Offer Provider directly when you arrive. By completing a prepaid booking on the website, you agree to pay Ezairticket using the payment method of your choice for our services in facilitating the Booking with the Offer Provider as shown on the website. Ezairticket will confirm your reservation and handle the Booking with the Offer Provider.

2.3 Pay-later Bookings are Bookings that are displayed on the Website and for which you will pay the Offer Provider directly when you arrive. By making a Pay-later Booking, you establish a legally-binding relationship directly with the applicable Offer Provider. Ezairticket only serves as a middleman between you and the Offer Provider, forwarding to the Offer Provider the pertinent information about the Offer and the Booking and sending you an email confirming the Booking on the Offer Provider's behalf.

2.4 The Website has a fraud detection system that has the ability to refuse payments and other services that are performed through the Website. Ezairticket is entitled to refuse payments and other services at any time, or to ask you for further information or to validate a payment or other actions performed via the Website and/or to Ezairticket. Ezairticket will not be held accountable or liable for any damages that may arise from such actions, such as in the event that an Offer is no longer available for Booking as a result of a refused payment.

2.5 By accessing the Website, you:
a. agree to be bound by these Terms of Use; and
b. warrant that you have attained the age of 18 years.

3. Prohibited Activities

You shall not:

a. reproduce in a material form, publish, perform in public, communicate to the public, or make an adaptation of the Information or any part of the Information other than for the Permitted Purpose;

7.2 Ezairticket exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the Website including the guest reviews and translated content, and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our expressed written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the Website or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to FinsHotel for no consideration.
